One of the major issues facing unionization and the targeted employees they want to organize is what is known as the Employee Free Choice Act. It is argued that this legislation severely hinders the democratic process of voting against the union particularly with regard to privacy.

Traditionally, union votes are done by secret ballot elections and overseen by the National Labor Relations Board representatives. However, unions many times lose these types of elections and as a result push for what is known as a card-check system.

In a card-check system, employees’ votes are public and as a result, employees are typically subjected to intense pressure to vote in favor of the union. It is for this reason and others that the Employee Free Choice Act has been under such heated debate by those who wish to keep the secret ballot elections in place citing that this legislation clearly takes away the employees right to a fair process.
